Terms of Trade
INTRODUCTION AND GOVERNING LAW
These are the Terms & Conditions of Sale applicable to on-line purchases from Hydropal Australia Pty. Limited ("HPAL"). These conditions should also be read in conjunction with HPAL's General Website Terms and Conditions of use. These terms and the laws of New South Wales, Australia, apply to all transactions for the purchase of HPAL products ("Products") from HPAL through its web site at https://www.ecopro2.com.au and any associated web page (the "Site").
These terms represent the complete Agreement between HPAL and the Buyer covering the sale of Products from this Site. Except for terms implied by applicable legislation, HPAL does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Buyer's completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by HPAL.
PRICES The prices to be paid by the Buyer for all Products will be HPAL's current selling price on the date of receipt by HPAL of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Delivery Charges and Checkout pages. HPAL reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website exclude Australian Goods and Services Tax (GST) at 10%.
The GST payable by the Buyer will be shown on Checkout: Shopping Summary screen and on the invoice sent to the e-mail address recorded by the customer. Delivery charges to the nominated address will be advised to the Buyer on the Delivery Charges and Checkout screens.
VOUCHERS From time to time EcoPro2 presents customers with vouchers, and may be used/redeemed on Shop Online to reduce the order value. Only one voucher may be used at a time, and cannot be combined and used on the same order. Vouchers must be used prior to their expiry date, and in accordance with the conditions issued with that voucher.
E-MAIL ADDRESSES & INVOICES It is important that you enter a valid e-Mail address, as invoices (in PDF format) are automatically e-Mailed to that address. Please ensure your e-Mail address is accurate. Also check your spam folder for undelivered invoices.
STOCK AVAILABILITY If a Product is "out of stock" when HPAL processes an Order, HPAL will contact the Buyer to discuss revised delivery times or refund options.
ORDERS All Orders made by the Buyer under this Agreement must be placed using the webpages on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products (b) The full street address to which the Product is to be delivered (c) Current billing address to which credit card statements are sent.
The Buyer must complete all information requested on this website and credit card payment sites for the Order to be processed by HPAL.
HPAL will not accept orders:
(a) From trade customers who are buying Products for resale; (b) If the Buyer does not offer to pay by one of the credit cards or Payment optionsl listed in this website; (c) If the Buyer's credit card provider does not confirm the payment; or (d) On back-ordered or out-of-stock products.
HPAL will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If HPAL does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.
DELIVERY Delivery of a Product should occur between 1-7 business days after processing of an Order. A Buyer cannot arrange collection of Orders from EcoPro2.
COURIER METHODS & SHIPMENTS When Australia Post is unable to deliver your parcel, it will be returned to your nearest local post office for your collection. For DHL deliveries the driver will leave a card to call if they cannot deliver it the following day.
The Buyer acknowledges that HPAL may, from time to time, be subject to production, delivery or other unforeseen delays and that HPAL may allocate distribution of Products ordered among its customers at its sole discretion.
If Buyer's Order has not been delivered within a reasonable time, the Buyer should first refer to HPAL warehouse dispatch e-mail, clicking on the delivery checker link.
HPAL reserves the right to make partial delivery of an Order. Please ensure delivery addresses are correct prior to placing order, once an order is processed by our warehouse, we are unable change or redirect the delivery address.
PAYMENT Payment for Products purchased from HPAL via the Site can be made by the following methods:
- VISA or MasterCard credit cards via the credit card gateway
The Buyer agrees to submit to HPAL such information as may be reasonably requested by HPAL or the credit card provider for the authorization and verification of its credit card purchases.
Please note that Buyer credit card numbers and details are not processed or retained on HPAL systems. Credit card providers may activate additional security measures, such as Verified by Visa or MasterCard SecureCode on your credit card (requiring an additional password). We have no control or access to credit card authentication systems. For all credit card issues you must contact your bank or credit card provider. HPAL reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider. In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, HPAL at its discretion may delay or cancel delivery of Orders placed by the Buyer. HPAL may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to HPAL. If the Buyer's account is placed in collection, HPAL will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.
DEAD ON ARRIVAL (DOA) A Product (except Factory Seconds) is deemed to be DOA if it fails to function according to its specifications either on set-up by the Buyer or within 14 days of its purchase date. The time period for calculating DOA commences two working days after delivery of a Buyer's Order. If the Buyer believes that a Product is DOA, they must contact EcoPro2 Technical Support on 1300 547 844 report the DOA status and discuss the fault. If HPAL considers the Product to be DOA, it will issue a Return Material Authorisation (RMA) Number and will send a DOA label, consignment note and return instructions to the Buyer. HPAL will pay the freight cost associated with the return of a DOA Product, provided that the Buyer uses the HPAL nominated freight carrier. HPAL will deliver a replacement Product to the Buyer promptly upon receipt of the deemed DOA product. FREIGHT METHODS HPAL will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer must not arrange its own courier to collect the Products from HPAL.
INCORRECT SUPPLY OF ORDER If due to a warehouse or other error on the part of HPAL, the Buyer receives a Product which does not conform to its Order, the Buyer must contact HPAL within 7 days of receipt of the Product. After returning the original Product to HPAL, provided that the returned Product is in new condition with its original packaging unopened, HPAL will ship the originally ordered product. Before returning a Product, the Buyer must obtain from HPAL an email authorising the return. email@example.com
PRODUCTS DAMAGED IN TRANSIT Claims for alleged damage to Products caused in transit from HPAL to the destination specified by the Buyer must be notified to HPAL as stated below within 48 hours of receipt of delivery and the consignment note must be marked as "Received Damaged".
DELIVERY OUTSIDE AUSTRALIA HPAL is unable to accept Orders or deliver to addresses outside Australia.
NOT FOR EXPORT OUTSIDE AUSTRALIA Products ordered via the EcoPro2 Australia Shop Online website are for Australian use only, and are not to be exported.
AMENDMENT OF TERMS AND CONDITIONS HPAL may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.
CARTON DAMAGED From time to time EcoPro2 offers a limited number of products that may have slight cosmetic damage to the outside carton. These products are undamaged and come with a full EcoPro2 new product warranty.
These documents constitute the entire agreement between you and Hydropal Australia Pty Ltd.
